1. Acceptance of Terms

By accessing this website or placing an order with OEM Parts Department, you agree to be bound by these Terms of Service, our Return & Refund Policy, and our Warranty Information. If you do not agree, you may not use this website or purchase products from us.

2. Use of Website

You agree to use this website for lawful purposes only. Any unauthorized use, interference with site functionality, or attempts to access restricted systems may result in termination of access.

3. Product Information & Availability

OEM Parts Department sells new, genuine OEM (Original Equipment Manufacturer) auto parts, including standard parts, freight items, body panels, and engines.

  • Product images are for reference only

  • Part numbers, pricing, supersessions, and availability are subject to change without notice

  • Orders are not guaranteed until shipment confirmation is issued

We reserve the right to cancel or limit quantities at our discretion.

4. VIN & Fitment Responsibility

A valid 17-digit Vehicle Identification Number (VIN) may be required to verify part compatibility.

  • Customers are responsible for providing accurate VIN and vehicle information

  • Parts are ordered based on the VIN or data provided

  • OEM Parts Department is not responsible for incorrect orders resulting from inaccurate or incomplete information

Orders placed without a VIN may be subject to cancellation or return restrictions.
If a customer declines to provide a VIN, all sales are final.

5. Pricing, Taxes & Payment

All prices are listed in U.S. dollars.

  • Prices exclude shipping, freight, handling, and applicable taxes unless stated

  • We reserve the right to correct pricing errors

  • Orders placed due to pricing errors may be canceled

Payment must be received in full before shipment.

6. Order Acceptance & Cancellations

OEM Parts Department reserves the right to accept, reject, or cancel any order.

  • Orders may be canceled before shipment only

  • Once shipped, orders are subject to the Return & Refund Policy

  • Special-order, VIN-specific, freight, engine, and body panel orders may not be canceled once processing begins

7. Shipping, Freight & Delivery

Shipping and delivery times are estimates and not guaranteed.

  • OEM Parts Department is not responsible for carrier delays

  • Risk of loss transfers to the customer once the carrier takes possession

  • Shipping and freight charges are non-refundable

Freight, engine, and body panel shipments must be inspected upon delivery.
Any visible damage must be noted on the carrier’s delivery receipt.

8. Freight, Body Panels & Engines (Industry Standard)

For freight, body panels, engines, and oversized items:

  • Items may ship via LTL or specialized carriers

  • Liftgate, residential, and accessorial fees are the customer’s responsibility unless otherwise stated

  • Missed delivery appointments or refused shipments may result in additional charges

  • Cosmetic variations in body panels (primer shade, surface finish) are normal and not considered defects

9. Returns & Restocking Fees

All returns are governed by the Return & Refund Policy.

  • Approved returns must be requested within 14 days of delivery

  • All approved returns are subject to a 20% restocking fee

  • Shipping and freight charges are non-refundable

  • Unauthorized returns may be refused or returned at the customer’s expense

10. Damaged or Incorrect Items

Claims for damaged or incorrect items must be reported within 48 hours of delivery and include supporting photos of:

  • The item

  • Packaging

  • Shipping label or freight receipt

Failure to report within 48 hours may result in denial of the claim.

11. No Labor or Installation Liability

OEM Parts Department is not responsible for:

  • Labor or installation costs

  • Removal or diagnostic fees

  • Towing or rental vehicles

  • Vehicle downtime or loss of use

This applies to all products, including engines and freight items.

12. Disclaimer of Warranties

OEM parts may carry a manufacturer’s limited warranty where applicable.

OEM Parts Department does not provide additional warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, beyond those offered by the manufacturer.

13. Limitation of Liability

To the fullest extent permitted by law:

  • OEM Parts Department is not liable for indirect, incidental, or consequential damages

  • Total liability is limited to the purchase price of the product

  • We are not responsible for damages resulting from misuse, improper installation, or incorrect application

14. Indemnification

You agree to indemnify and hold OEM Parts Department harmless from any claims, damages, losses, or expenses arising from:

  • Incorrect VIN or vehicle information

  • Improper installation or use

  • Violation of these Terms of Service

15. Intellectual Property

All content on this website, including text, images, logos, and trademarks, is the property of OEM Parts Department or its licensors and may not be used without written permission.

16. Governing Law (New York)

These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

17. Changes to Terms

OEM Parts Department reserves the right to update or modify these Terms at any time. Changes take effect immediately upon posting to the website.
